Vietnamese Deposition Translation

Vietnamese deposition translation for US litigation with a Vietnamese-speaking party: the certified transcript of testimony given through an interpreter, the Vietnamese exhibits marked during it, and the written statements that reach a US case from Vietnam, where no deposition exists and a court takes a biên bản lấy lời khai instead. We translate into English for the record and into Vietnamese for a party who needs to read what was said.

What makes a Vietnamese transcript hard to get right

Vietnamese testimony loses things in a flat English transcript. Pronouns, yes-words and dates carry meaning that the translation has to keep or flag.

Anh, em, chú, cháu: the pronouns are evidence

Vietnamese has no neutral I and you. A speaker picks a pair, anh and em, cô and cháu, ông and tôi, that states relative age, relationship and respect, and people shift pairs when a conversation turns hostile. A woman who calls a man anh and herself em is speaking as a partner or a younger woman; two men who use anh and em for each other are often business associates. In a recorded conversation offered as an exhibit, or a Vietnamese written statement, we keep the address terms in brackets at the points where they show a relationship the case turns on.

Dạ, vâng and the question that was actually answered

Dạ and vâng are polite particles that mean the listener heard you; they are not agreement, though an interpreter under time pressure may render both as yes. A Vietnamese answer to a negative question also follows the fact, not the grammar: to "You did not go?" a witness says "Dạ, không" and means "That is right, I did not." Where a transcript or a Vietnamese record contains these exchanges we translate the particle as an acknowledgment, render the answer by its meaning, and leave the Vietnamese in brackets so counsel can argue over it with the original in view.

Dates, ages and money the way a witness in Vietnam gives them

Dates come day first, and an older witness may give a birthday by the âm lịch, the lunar calendar, or an age by the customary count that adds a year. Money comes in triệu and tỷ đồng, and the price of a house is often stated in cây vàng, taels of gold, because that is how the deal was done. Northern and southern words for the same relative, bố and ba, mẹ and má, land on one English word. We keep the unit the witness used, add the Gregorian date or the gram weight in brackets only when counsel asks, and never silently convert.

Who is asking for your Vietnamese deposition translation?

The translation is the same. What changes is whether the recipient wants anything added to it.

Courts

A deposition filed in a US court needs a complete English translation with a signed certification from the translator. Some judges want it notarized as well, so check the local rules.

Certified translations

Bankruptcy courts

A Rule 2004 examination or a deposition in a bankruptcy case is filed with a certified translation of the testimony and of any foreign-language exhibits.

Bankruptcy court translations

Courts abroad

Testimony taken in the US for a case in another country usually goes out with an apostille on the reporter's certificate and a translation into that country's language.

Apostille service

Before you upload

Three things that save a day of back and forth on a Vietnamese deposition.

01

Send the certified transcript, not the rough draft

Court reporters issue a rough draft first and the certified transcript later. Order the translation from the certified copy, with the reporter's certificate page.

02

Include the exhibits the witness was asked about

A deponent is often questioned on a letter or a contract marked as an exhibit. If those are in another language too, upload them in the same order so the terms are translated the same way.

03

Expect many pages and tell us the deadline

A transcript can run to a few hundred pages, and the quote counts words, not sheets. Upload the file to see the price before you pay, and put the filing date in the order notes.

Vietnamese Deposition FAQ

Most questions about pricing and turnaround can be answered faster by requesting a quote.

Request a Quote

Can a deposition be taken in Vietnam, and what comes back if not?
Vietnam is not party to the Hague Evidence Convention, so a request for testimony goes by letters rogatory through diplomatic channels and is executed by a Vietnamese court. What returns is a biên bản lấy lời khai: the judge's questions and the witness's answers written down by a court clerk, signed on each page, with the court's seal. We translate it as a court record, keeping the question and answer form and the signatures and seals, and we label it so the US court does not mistake it for sworn testimony taken under US rules.
A witness in Vietnam signed a statement for our case. How is it certified, and is it usable?
A statement written in Vietnam usually comes as a bản tường trình or giấy xác nhận with the signature certified at the UBND xã, a chứng thực chữ ký, or signed before a công chứng viên. The certification confirms who signed, not that the contents are true, and no oath is taken. We translate the statement and the certification block with its number and date. Your lawyer decides what weight a US court will give it.
How do you count pages on a long transcript?
By words, not by the numbers printed on the transcript. A page is up to 250 words, and a court reporter's page in the standard format holds fewer words than that, so the count we quote is lower than the transcript's page count. Send the PDF and we return the figure before you order. Exhibits in Vietnamese, such as a contract or a bank record marked during the deposition, are counted the same way and can go on the same order.
How much does a certified translation cost?
Certified translation is $25 per page, with a page counted as up to 250 words. Notarization, a mailed physical copy and an apostille are optional and priced separately.
How long does a certified translation take?
Standard turnaround starts at 24 hours and depends on the length and language of your documents. If you have a deadline, include it in your quote request.
