Bản án or quyết định: two ways a Vietnamese court ends a marriage

A Vietnamese divorce is a court document, never a registry certificate, and its title tells a US reader how the case was decided.

Quyết định công nhận thuận tình ly hôn

When both spouses agree, the court where one of them lives, a district court before July 2025 and a Tòa án nhân dân khu vực, a regional court, since then, issues a quyết định công nhận thuận tình ly hôn và sự thỏa thuận của các đương sự, a decision recognizing the consensual divorce and the parties' agreement. It is short, often three or four pages, and takes effect on the day it is issued, so there is no appeal period to prove and no separate finality certificate to chase.

Bản án sơ thẩm and bản án phúc thẩm

A contested divorce, ly hôn đơn phương, ends in a bản án, a judgment. The first-instance judgment is marked sơ thẩm and becomes final fifteen days after delivery unless appealed; an appeal produces a second judgment marked phúc thẩm from the provincial court. The judgment opens with Nhân danh nước Cộng hòa xã hội chủ nghĩa Việt Nam, then runs through the facts, the nhận định của Tòa án, the court's findings, and the quyết định section. USCIS wants all of it, so a ten-page judgment is a ten-page translation.

Con chung, cấp dưỡng and tài sản chung

The ruling settles three things. Con chung, the children, with one parent named as the one who trực tiếp nuôi dưỡng, directly raises them. Cấp dưỡng, the monthly support the other parent pays. Tài sản chung, the marital property, or a line saying the parties asked the court not to decide it. Án phí, the court fee, closes the document. We translate these as custody, child support and marital property with the Vietnamese kept beside each term, because a US family court reading the decree for a later custody question needs the exact words.

Who is asking for your Vietnamese divorce decree translation?

The translation is the same. What changes is whether the recipient wants anything added to it.

USCIS

USCIS asks for a complete English translation and a signed certification from the translator. No notarization is needed.

USCIS translation requirements

Marriage license offices and courts

A county clerk issuing a marriage license, or a family court, needs to see the prior marriage ended. A certified translation of the decree is accepted, notarized where the office asks.

Certified translations

Registries abroad

To remarry or register a divorce in another country, the US decree usually needs an apostille and a translation into that country's language.

Apostille service

Before you upload

Three things that save a day of back and forth on a Vietnamese divorce decree.

01

Send every page of the judgment

A decree is complete only with its reasoning, its resolutive points and the finality note or certificate. Pages missing from the middle leave the translation unable to show the divorce is final.

02

Add the registry act or the margin note

Where the divorce was recorded at a civil registry, the act or the note on the marriage record is often the page a clerk wants. Upload it with the judgment.

03

Tell us if only part was requested

If the recipient asked for the ruling alone, say so at checkout. Otherwise we translate the full document, which is what USCIS requires.

Vietnamese Divorce Decree FAQ

Most questions about pricing and turnaround can be answered faster by requesting a quote.

My spouse was a foreign citizen. Why is the decree from the city court and not the district?
Before the court reform of July 2025, a divorce with a foreign spouse, or a spouse living abroad, was heard by the provincial court, such as the Tòa án nhân dân Thành phố Hồ Chí Minh, rather than a district court. The case number on the first page, in the form Số 123/2019/QĐST-HNGĐ, shows the year and the type of decision. We translate the court name and the case number exactly, since a consular officer uses them to check that the right level of court decided the case.
I divorced in the United States. Does Vietnam need a translation before I remarry there?
Yes. A Vietnamese citizen who divorced abroad must have the divorce recorded, a step called ghi chú ly hôn, before registering a new marriage in Vietnam. The office wants a certified copy of the US decree with an apostille, and a Vietnamese translation. We translate the decree and can notarize the translation. Offices differ on whether they take a translation made abroad, so call the one recording the divorce first.
The decree is a typed carbon copy from the 1980s. Can you work from it?
Usually, yes. Judgments from that period were typed with carbon paper, the seal is often faint and the pages are numbered by hand. Send the clearest scan you can of every page, including the back if anything is stamped there. The translator marks any word that cannot be read rather than guessing, and a few unreadable words in the findings rarely trouble USCIS as long as the ruling is clear.
How much does a certified translation cost?
Certified translation is $25 per page, with a page counted as up to 250 words. Notarization, a mailed physical copy and an apostille are optional and priced separately.
How long does a certified translation take?
Standard turnaround starts at 24 hours and depends on the length and language of your documents. If you have a deadline, include it in your quote request.
