Haitian divorce decree translation to English for an I-130 after a remarriage, a K-1 petition, a naturalization interview that asks about every prior marriage, or a US family court. A Haitian divorce leaves two documents behind: the jugement de divorce of the tribunal de première instance and the transcription the officier de l'état civil makes once it is final. We translate both from the French.
Jugement, transcription, extrait: the papers of a Haitian divorce
USCIS wants proof that the divorce is final, and in Haiti that proof is split between a court and a civil registry office.
The jugement de divorce
The divorce is heard by the tribunal de première instance, called the tribunal civil, of the place where the respondent lives, and the petition goes first to the doyen. The judgment recites the grounds the Code civil allows: adultery, excès, sévices et injures graves, or the spouses' mutual consent. It is read in public hearing, carries the conclusions of the Ministère Public, and ends with a dispositif that pronounces the divorce. Many are jugements par défaut, where the respondent never appeared. We translate the full text, including the formulas Au nom de la République and Par ces motifs, and keep the court's own paragraph order.
Transcription at the état civil
A judgment alone does not end a Haitian marriage. The petitioner has two months to present it to the officier de l'état civil, who transcribes it in the register and issues the acte de divorce, and the marriage entry receives a note in the margin. An officer at USCIS who sees only the jugement will ask for this transcription. The translation of the acte de divorce names the register, the date of transcription and the officier, since that is the date the divorce took effect, and later the Archives Nationales can issue an extrait of the same entry.
A Florida divorce, sent to Haiti
The reverse direction is just as common. A couple married in Haiti divorces in Miami or Brooklyn, and one of them wants to remarry in Haiti or settle property there. The tribunal civil grants exequatur to the US judgment before the officier will transcribe it, and the lawyer in Port-au-Prince needs the final judgment, the marital settlement agreement and the clerk's certification in French. We translate the whole packet, keep the case number and the judge's name as printed, and notarize the translation if the court asks.
Who is asking for your Haitian Creole divorce decree translation?
The translation is the same. What changes is whether the recipient wants anything added to it.
USCIS
USCIS asks for a complete English translation and a signed certification from the translator. No notarization is needed.
A county clerk issuing a marriage license, or a family court, needs to see the prior marriage ended. A certified translation of the decree is accepted, notarized where the office asks.
Three things that save a day of back and forth on a Haitian Creole divorce decree.
01
Send every page of the judgment
A decree is complete only with its reasoning, its resolutive points and the finality note or certificate. Pages missing from the middle leave the translation unable to show the divorce is final.
02
Add the registry act or the margin note
Where the divorce was recorded at a civil registry, the act or the note on the marriage record is often the page a clerk wants. Upload it with the judgment.
03
Tell us if only part was requested
If the recipient asked for the ruling alone, say so at checkout. Otherwise we translate the full document, which is what USCIS requires.
Details and pricing
What is included in a Haitian Creole divorce decree translation
One price per page covers the translation and its certification. A page is up to 250 words, and the quote tells you the page count before you pay.
Everything on the divorce decree is translated, including stamps, seals and handwritten notes. Tell us the English spelling you use for each name when you order.
I only have the jugement. Will USCIS accept it without the acte de divorce?
Sometimes, but the officer may issue a request for evidence asking for proof the judgment was transcribed. Have a relative or lawyer in Haiti obtain the acte de divorce from the bureau de l'état civil, or the extrait from the Archives Nationales, and we translate it to match the jugement already in your file. Translating the judgment first is still worth it, because it is the longer document and takes more time.
Why does my judgment talk about a reconciliation attempt and a one-year separation?
Haitian procedure sends the spouses before the doyen for a reconciliation attempt before the case is heard, and in a divorce granted for sévices the court orders a year of separation first and grants the divorce only if the spouses have not reunited. Those steps appear in the judgment as dated events. We translate them as written, because the dates show a US officer that the court followed its own procedure.
How many pages is a Haitian divorce judgment, and what does that cost?
A jugement de divorce usually runs several typed pages, since it repeats the petition, the procedural history and the court's reasoning before the dispositif. The acte de divorce is one page. We count pages at up to 250 words each at $25, so a long judgment on a few dense pages may count as more pages than the paper shows. Upload it and the quote comes back with the exact count before you pay.
How much does a certified translation cost?
Certified translation is $25 per page, with a page counted as up to 250 words. Notarization, a mailed physical copy and an apostille are optional and priced separately.
How long does a certified translation take?
Standard turnaround starts at 24 hours and depends on the length and language of your documents. If you have a deadline, include it in your quote request.
