Which Spanish divorce document do you have?

A divorce in Mexico, Spain or Colombia can end in a court judgment, a notarial deed or a registry act, and the recipient may want more than one of them.

Judgment, act and margin note in Mexico

A judicial divorce ends with a sentencia from a juzgado familiar that must state it is firme or has causado ejecutoria, meaning no appeal is pending. The court sends it to the Registro Civil, which issues an acta de divorcio repeating the resolutive part and notes the divorce on the original marriage act. For USCIS the sentencia with its finality statement is the decree; a county clerk issuing a marriage license is often content with the acta. We translate whichever you hold and keep the finality date where it appears.

Divorces with no judge at all

Couples with no minor children can divorce without a court: before the Registro Civil in most Mexican states, called divorcio administrativo; before a notary in Spain since 2015 under the Ley de Jurisdicción Voluntaria; and before a notary in Colombia since 2005 by escritura pública. What you get is an acta or a deed, not a judgment, and a US reader may not recognize it as a divorce. The translation names the document precisely and carries the notary's or registrar's attestation so it reads as the final record it is.

Considerandos, puntos resolutivos and the convenio

A contested sentencia can run twenty pages of considerandos before the puntos resolutivos that dissolve the marriage, settle custody, set the pensión alimenticia and divide the sociedad conyugal. A mutual-consent divorce attaches the convenio the couple signed. USCIS wants the full document, not a summary, so we translate every page. A page is up to 250 words, and a dense court page often counts as two.

Who is asking for your Spanish divorce decree translation?

The translation is the same. What changes is whether the recipient wants anything added to it.

USCIS

USCIS asks for a complete English translation and a signed certification from the translator. No notarization is needed.

USCIS translation requirements

Marriage license offices and courts

A county clerk issuing a marriage license, or a family court, needs to see the prior marriage ended. A certified translation of the decree is accepted, notarized where the office asks.

Certified translations

Registries abroad

To remarry or register a divorce in another country, the US decree usually needs an apostille and a translation into that country's language.

Apostille service

Before you upload

Three things that save a day of back and forth on a Spanish divorce decree.

01

Send every page of the judgment

A decree is complete only with its reasoning, its resolutive points and the finality note or certificate. Pages missing from the middle leave the translation unable to show the divorce is final.

02

Add the registry act or the margin note

Where the divorce was recorded at a civil registry, the act or the note on the marriage record is often the page a clerk wants. Upload it with the judgment.

03

Tell us if only part was requested

If the recipient asked for the ruling alone, say so at checkout. Otherwise we translate the full document, which is what USCIS requires.

Spanish Divorce Decree FAQ

Most questions about pricing and turnaround can be answered faster by requesting a quote.

Request a Quote

Do I have to translate the whole sentencia, or only the final ruling?
For USCIS, the whole thing. The certification states that the translation is complete, and a decree with pages left out is not. If the recipient told you in writing that the puntos resolutivos are enough, upload only those pages and say so at checkout. Pricing is by page, so a long judgment costs more than a one-page acta.
My divorce was signed at a notary in Spain or Colombia. Does that count as a decree?
Yes. A Spanish escritura pública de divorcio or a Colombian notarial divorce dissolves the marriage with the same effect as a judgment, and the deed records the date, the notary and the agreement. Send the whole deed, including the convenio attached to it, and we translate it as a notarial divorce deed so the reader knows what it is.
Can you translate a US divorce decree into Spanish so I can remarry in Mexico or Spain?
Yes. The registry abroad will want the decree with its certificate of finality, usually apostilled by the state that issued it, and a translation into Spanish. Both Mexico and Spain may require a local court or registry to recognize the foreign judgment before you can remarry, so ask the Registro Civil what it needs before you order. We can notarize the translation if the office asks.
How much does a certified translation cost?
Certified translation is $25 per page, with a page counted as up to 250 words. Notarization, a mailed physical copy and an apostille are optional and priced separately.
How long does a certified translation take?
Standard turnaround starts at 24 hours and depends on the length and language of your documents. If you have a deadline, include it in your quote request.
