Решение суда or свидетельство о расторжении брака: which one proves the divorce
A couple without minor children who both agree divorce at the ЗАГС and leave with a certificate. Everyone else goes to court first, and the certificate comes afterwards.
The court judgment and its stamp
A divorce with no dispute over the children goes to a мировой судья; a dispute over where the children live, or a large property claim, goes to the районный суд. The решение names the parties, the date and place of the marriage registration, states that the marriage is dissolved, and may set алименты and where the children live. Since 2013 a мировой судья may issue only the резолютивная часть, the operative paragraphs, unless a party asks for the full reasoning. The stamp that matters is решение вступило в законную силу with a date, because the marriage ends on that date, not on the hearing date.
The certificate that follows
After the judgment either spouse takes it, or a выписка из решения суда, to the ЗАГС, which records the dissolution and issues the свидетельство о расторжении брака. The certificate gives the date the marriage ended, the ground (по решению суда or по совместному заявлению супругов), the number of the запись акта and the surname each spouse carries after the divorce. USCIS usually accepts the certificate alone as proof the marriage ended; a US court dealing with support or custody needs the judgment. Terms with no US equivalent
A Russian judgment uses terms a US court reads differently. Алименты is child support, set as a fraction of income, a quarter for one child, a third for two, half for three or more, rather than a dollar figure. Место жительства ребёнка is which parent the child lives with; there is no joint physical custody order to translate. Совместно нажитое имущество is marital property, usually split in a separate claim. We translate each term with the Russian in brackets the first time so a US lawyer can see what was ordered.

- I divorced in court and never collected the certificate. Will USCIS accept the judgment?
- Usually yes, provided the judgment carries the stamp showing it took legal effect, and we translate that stamp. Under Russian law the marriage is dissolved on that date even if nobody went to the ЗАГС afterwards. Some officers still ask for the свидетельство о расторжении брака, and a relative in Russia or a lawyer with a power of attorney can obtain it from the ЗАГС where the marriage was registered or where either spouse lives.
- My only proof of the divorce is a stamp in my passport.
- The семейное положение page of the internal passport shows a брак расторгнут stamp with the ЗАГС office, the date and the entry number. We translate that page as a document in its own right, with the photo page so the stamp is tied to you. It is enough for some purposes, but for a marriage license or an immigration petition order the повторное certificate as well, because the stamp is a reference to the record rather than the record itself.
- Can you translate a US divorce decree into Russian?
- Yes. Russia recognizes a foreign divorce without a court process if it was valid where it was granted, but a Russian ЗАГС will not register a new marriage, and a notary will not handle an estate, without a translated decree. US decrees run to many pages because the settlement is attached; a ЗАГС usually only needs the pages that state the marriage is dissolved and the date, plus the apostille. Send us only the pages the office asked for.
