협의이혼 or 재판상 이혼: the papers differ

Most Korean divorces are by agreement and never produce a judgment. The US recipient still needs something to read.

Divorce by agreement

In a 협의이혼 the couple appears at the 가정법원, waits out a 숙려기간 of one month, or three months when there are minor children, and receives an 이혼의사확인서, the court's confirmation of intent to divorce. The divorce takes effect only when one spouse files the 이혼신고 at the 구청 within three months. There is no decree. What proves the divorce is the 혼인관계증명서 in its 상세 version, showing the 이혼 entry and its date, and the 확인서 if it was kept.

Judicial divorce and the 판결문

A contested divorce ends in a 판결문 from the 가정법원, or a 조정조서 when the parties settled in mediation. The judgment has a 사건번호 such as 2023드단1234, the 주문 first, then the 청구취지 and the 이유. To show the judgment is final, the court issues a 확정증명원, and USCIS and US courts want the two together. We translate the full judgment, order and reasoning both, and the 확정증명원 as a separate page.

Terms with no US equivalent

A Korean decree splits parental authority, 친권, from physical custody, 양육권, and can give them to different parents. 양육비 is child support and 면접교섭 is visitation. 위자료 is compensation paid by the spouse at fault for the breakdown, which has no direct counterpart in most US states, and 재산분할 is the property division. We keep each term distinct in English and add the Korean in brackets the first time it appears, so a US judge reading a custody order knows which right is which.

Who is asking for your Korean divorce decree translation?

The translation is the same. What changes is whether the recipient wants anything added to it.

USCIS

USCIS asks for a complete English translation and a signed certification from the translator. No notarization is needed.

USCIS translation requirements

Marriage license offices and courts

A county clerk issuing a marriage license, or a family court, needs to see the prior marriage ended. A certified translation of the decree is accepted, notarized where the office asks.

Certified translations

Registries abroad

To remarry or register a divorce in another country, the US decree usually needs an apostille and a translation into that country's language.

Apostille service

Before you upload

Three things that save a day of back and forth on a Korean divorce decree.

01

Send every page of the judgment

A decree is complete only with its reasoning, its resolutive points and the finality note or certificate. Pages missing from the middle leave the translation unable to show the divorce is final.

02

Add the registry act or the margin note

Where the divorce was recorded at a civil registry, the act or the note on the marriage record is often the page a clerk wants. Upload it with the judgment.

03

Tell us if only part was requested

If the recipient asked for the ruling alone, say so at checkout. Otherwise we translate the full document, which is what USCIS requires.

Korean Divorce Decree FAQ

Most questions about pricing and turnaround can be answered faster by requesting a quote.

I divorced by agreement in Korea. There is no court order. What do I give USCIS?
The 혼인관계증명서 (상세) with the 이혼 entry is the proof, and the reciprocity schedule lists it as the Korean divorce record. Order it from a 구청, a Korean consulate or 전자가족관계등록시스템, and we translate it with the 이혼의사확인서 if you still have it. A general version that only shows no current spouse is not enough, because it hides the dates.
Can you translate my US divorce decree into Korean so I can remarry in Korea?
Yes. A Korean citizen divorced in the US reports the divorce at the consulate or a 구청 with the US decree, a certificate showing it is final, and a Korean translation that names the translator. Once the 이혼 is entered on the 혼인관계증명서 you can file a new 혼인신고. We also translate the custody and support pages when a Korean court will apply them.
Do you translate the whole 판결문 or just the order?
The whole thing. A US court or officer wants to see who filed, on which ground under 민법 제840조, what the court found, and what it ordered on custody, support and property. A judgment runs several pages at $25 per page of up to 250 words, and the 확정증명원 adds one more. If you only need the order for a marriage license, say so and we will quote the fewer pages.
How much does a certified translation cost?
Certified translation is $25 per page, with a page counted as up to 250 words. Notarization, a mailed physical copy and an apostille are optional and priced separately.
How long does a certified translation take?
Standard turnaround starts at 24 hours and depends on the length and language of your documents. If you have a deadline, include it in your quote request.
